1. Introduction and Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of the website, application, and services provided by Orange Chat Technologies Private Limited ("Company", "We", "Us"). By accessing or using our services, you explicitly agree to be bound by these Terms and our Privacy Policy.

Age Restriction: You must be at least 18 years old to use the Services.

Changes to Terms: We reserve the right to modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the new Terms.

2. Definitions

  • "Company", "We", "Us": Refers to ORANGE CHAT TECHNOLOGIES PRIVATE LIMITED.
  • "User", "You": Refers to the individual or entity accessing the Services.
  • "Website / Application": Refers to www.getcontactme.com and/or ContactME.
  • "Content": Refers to any text, images, audio, video, or data displayed through the Services.

3. User Accounts & Verification

3A.1 OTP Verification: Users must verify their mobile phone number via a one-time password (OTP).

3A.2 Unique Identifier: No separate username/password is required; the verified mobile number serves as the unique account identifier.

3A.3 Access: Once verified, users may access services and chat directly with vendors.

3A.4 Profile Updates: Users may optionally add a name, email, and profile picture.

3A.5 Number Changes: If a mobile number is updated, it must undergo a new OTP verification.

3A.6 Responsibility: Users are solely responsible for the accuracy of their number and maintaining access to it.

4. Description of Services & Vendor Listings

4A. Location-Based Services:

  • 4A.1 ContactME provides vendor recommendations based on device location, subject to explicit consent.
  • 4A.2 If denied, users will receive generalized (less relevant) listings.

4B. Vendor Listings Disclaimer:

  • 4B.1 Data is synchronized from Google Places / Google Business Profiles.
  • 4B.2 Vendors must update business info directly via Google Business.
  • 4B.3 ContactME is not responsible for inaccuracies or outdated details sourced from Google.
  • 4B.4 Presence on the platform does not constitute an endorsement or guarantee of vendor quality.

5. User Conduct & Communications

5.1 Prohibited Activities:

The following activities are strictly prohibited:

  • Unlawful use
  • Harmful content
  • IP infringement
  • Malware
  • Harassment
  • Spamming
  • Data scraping
  • Impersonation

5A. Chat History:

  • 5A.1 Users may initiate chats with vendors via the platform.
  • 5A.2 Chat records are archived and may be retained post-account deletion to prevent fraud, comply with legal obligations, or assist in dispute resolution.

6. Intellectual Property Rights

All intellectual property belongs to the Company. Users are granted a limited, revocable license for personal, non-commercial use. Users retain ownership of their uploaded content but grant the Company a worldwide license to use and display it.

7. Fees, Payments, and Liability

7A.1 Consumer Rights: Users may have rights under EU/Indian consumer protection laws.

7A.2 Intermediary Role: ContactME is an intermediary; claims must be directed to the vendor.

7A.4 Liability Cap: Maximum liability is limited to the amount paid in the last 1 month or INR 1,000, whichever is lower.

8. Disclaimers

Services are provided "AS IS" and "AS AVAILABLE". We do not guarantee uninterrupted or error-free operation.

9. Data Protection (GDPR & Indian Law)

9A.2 User Rights: Users have the right to access, correct, delete, or restrict processing of their data.

9A.4 Retention: Account info is kept until deletion; chat history is kept for up to 1 year; payment records are kept per financial regulations.

10. Governing Law & Dispute Resolution

Jurisdiction: These terms are governed by the laws of India.

Arbitration: Mandatory binding arbitration under the Arbitration and Conciliation Act, 1996.

Courts: Exclusive jurisdiction in Indian courts.
